Bills voted on Third Consideration

SB 1284 (BAKER) Amends Title 18 (Crimes and Offenses) to impose a mandatory minimum sentence of 20 years and increase the maximum sentence to up to life imprisonment for attempt, conspiracy, or solicitation to commit murder of a law enforcement officer where serious bodily injury resulted. Authorizes a sentence of up to 40 years where serious bodily injury does not result. PASSED 41-8.

SB 1091 (FARRY) Designates a bridge carrying Pennsylvania Route 513 over Neshaminy Creek in Hulmeville Borough, Bucks County, as the Corporal Robert Lee Clampffer Memorial Bridge. PASSED 49-0.

SB 250 (DUSH) Establishes the Display of the Preamble of the Constitution of Pennsylvania Act to require the governing board of each school entity to display the Preamble of the Pennsylvania Constitution in the entranceway of each school building. PASSED 36-13.

SB 598 (DUSH) Establishes the Display of the Preamble Act to require the governing board of each school entity to display the Preamble of the United States Constitution in the entranceway of each school building. PASSED 36-13.

SB 1286 (J. WARD) Amends Title 75 (Vehicles) to make it a misdemeanor to unintentionally cause the death of another person by careless driving. Subjects convictions to a fine up to $2,500 and two-year suspension of operating privileges. OVER AS AMENDED.

     A03192 (J. WARD) Specifies the suspension of operating privileges commences upon receiving a certified record of the driver’s conviction or an adjudication of delinquency. ADOPTED 31-18.

SB 1294 (J. WARD) Amends the Private Licensed Schools Act to increase the maximum civil penalty the State Board of Private Licensed Schools may, by a majority vote of its members, levy on a licensee who violates the Private Licensed Schools Act or on a person who operates a private licensed school without being properly licensed, from $2,500 to $25,000. OVER AS AMENDED.

     A03195 (J. WARD) Guts the bill and allows State Board of Private Licensed Schools, by a majority vote of its members, to levy a civil penalty of up to $25,000 on any person who provides training without being properly licensed. Limits the assessment of civil penalties to once per violation. AGREED TO.

SB 375 (BROWN) Amends the Public School Code of 1949, to provide funding, discounts and donations for AED devices and training; to require AEDs in school buildings and athletic fields for school entities and nonpublic schools participating in interscholastic sports; and to provide for related training, certification and instruction in the use of CPR and AEDs. CONCURRED IN HOUSE AMENDMENTS 47-3.

SB 822 (LANGERHOLC) Amends Titles 18 (Crimes and Offenses) and 53 (Municipalities Generally) to provide that a person adversely impacted by a local regulation of firearms or ammunition, where the local regulation was promulgated or enforced in violation of state law, may seek specified relief or damages attributable to the local regulation. Confirms that the laws of the Commonwealth regulating firearms or ammunition preempt and supersede any local regulation of firearms or ammunition. PASSED 30-20.

SB 1295 (J. WARD) Amends Title 75 (Vehicles) to provide an English proficiency standard for individuals operating a commercial motor vehicle in the Commonwealth. Makes it a summary offense to operate a commercial motor vehicle and fail to meet the English proficiency standard. PASSED 32-18.

SB 1298 (LANGEHOLC) Amends Title 75 (Vehicles) to exempt the five newest model year vehicles, eliminate the gas cap test under certain conditions, and remove certain counties from the Vehicle Emissions Inspection and Maintenance (I/M) program. AMENDED AND PASSED 29-21.

     A03248 (LANGERHOLC) Guts bill and removes all 25 counties currently in the Vehicle Emissions Program from the program. Provides that if the removal of a county would result in the loss of federal funding that the county may remain in the program on the basis that DEP will continue to file further amendments to the SIP to remove the remaining counties. Clarifies that no additional counties may enter the program. ADOPTED 27-23.

SB 1294 (J. WARD) Amends the Private Licensed Schools Act to allow the State Board of Private Licensed Schools, by a majority vote of its members, to levy a civil penalty of up to $25,000 on any person who provides training without being properly licensed. Limits the assessment of civil penalties to once per violation. AMENDED AND PASSED 48-2.

     A03272 (J. WARD) Guts bill and allows the board, by a majority vote of its members, to levy a civil penalty of up to $25,000 on any person who provides entry level driver training as required by Federal regulations without being properly licensed. Limits the assessment of civil penalties to once per violation. ADOPTED 27-23.
