Senate Approves Bill to Update PA's
Ticket Resale Law
The Senate today approved legislation intended to
create a safe, legal and more open system in which to
buy and sell tickets for sporting events, concerts and
other activities.
Senate Bill 86, sponsored by Senator Tommy Tomlinson
(R-Bucks), would update Pennsylvania's ticket resale
law to allow the owner of an event ticket to resell
that ticket through an Internet-based reseller such as
TicketMaster, StubHub or eBay. The reseller meet must
certain physical presence requirements and provide a
consumer guarantee and refund in the event that the
ticket is invalid or the event is cancelled.
Current state law forbids ticket owners from reselling
their tickets for above face value without obtaining a
resellers license. There is also a 25-percent cap on
the permissible resale price. Pennsylvania is one of
only 15 states that regulates the price at which
tickets can be resold.
Senate Bill 86 would create a safe, reasonable and
legal means for a ticket owner to resell tickets.
Most importantly, it would provide a consumer
guarantee to ensure that a purchaser would receive a
full refund if an event is cancelled or the ticket is
deemed invalid because of fraud or some other
occurrence.
