Senate Approves White Bill Cracking Down on Fake ID Users
Senate Bill 117 would allow confiscation of bogus cards
The Senate overwhelmingly approved legislation sponsored by Senator Don White
(R-41) that would crack down on the use of false ID cards by giving new powers
to the owners and employees of establishments where alcohol is sold.
Senate Bill 117 would allow any person who is authorized to sell liquor or
malt or brewed beverages (state store clerks, beer distributors, restaurant or
bar employees) to confiscate an identification card when they have a reasonable
suspicion the card has not been lawfully issued to the individual.
The Senate approved the bill by a 48-1 vote on Monday. It now goes to the
House of Representatives for consideration.
Under the bill, the seller must verify the age of the purchaser by placing
the identification card through an electronic scanner. It requires a confiscated
identification card to be submitted to law enforcement within 48 hours to
determine whether it is valid.
Senator White has introduced variations of this bill during each legislative
session since 2006. "I guess this just shows that persistence pays off," he
said. "Often it takes time to craft legislation. In this case, the bill was
appropriately refined as we received comments and concerns from a number of
interested parties. Hopefully, the House will take it up soon and we can move
it on to the Governor’s desk for his signature and enactment into law."
