Rafferty Bill Promoting Good Samaritan Behavior Headed to
Governor's Office, Expected to be Signed into Law
HARRISBURG – Legislation sponsored by Senator John Rafferty (R-Montgomery) to
provide immunity from prosecution for minors for underage drinking and
possession of alcohol if they call 911 to help an intoxicated friend in an
emergency situation is now headed to the Governor's office where it is expected
to be signed into law. Rafferty's legislation had previously passed the Senate
in May and was amended by the state House to address the possession of alcohol.
The state Senate unanimously passed the amended legislation Thursday evening.
Rafferty, who has been an ardent supporter and author of tougher laws to
prevent underage drinking, said, "No one is trivializing the serious issue of
underage drinking, but if we can prevent needless tragedies and help save one
life with this legislation, then it will be worth it."
Senate Bill 448 will grant immunity to the first person to call 911 to
report that another person needs medical attention when underage drinking is
involved and there is a reasonable belief that the individual was in need of
immediate medical attention to prevent death or serious injury. The caller must
provide their name to the 911 operator and must remain with the person until
paramedics arrive. Additionally, the legislation will grant immunity if alcohol
is found in possession of the individual calling for emergency assistance.
